Agreement to Terms

By accessing or using the wind-beaver website and services, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site and services.

Service Description

wind-beaver provides strategic career transformation coaching services for performing artists. Our services include consultation, strategic analysis, coaching programs, and educational materials designed to support career development in the entertainment industry.

All information provided through our services is for educational and strategic guidance purposes. It does not constitute professional representation, legal advice, financial advice, or guaranteed career outcomes.

Eligibility

Our services are available to individuals aged 18 years or older. By enrolling in our programs, you represent and warrant that you meet this age requirement and have the legal capacity to enter into binding contracts.

Enrollment and Payment

When you enroll in a coaching program:

  • You agree to provide accurate and complete information
  • You agree to pay the stated service fees in full before program commencement
  • Payment is due upon enrollment confirmation unless alternative arrangements are explicitly agreed in writing
  • All fees are quoted in Canadian Dollars (CAD)

Refund Policy

Given the personalized nature of our coaching services:

  • Full refunds are available if you cancel within 48 hours of enrollment and before the first consultation session
  • After the first consultation session begins, fees are non-refundable
  • No partial refunds are provided for programs discontinued mid-term by the client
  • In exceptional circumstances (serious illness, force majeure), program rescheduling may be considered on a case-by-case basis

Program Delivery and Client Responsibilities

wind-beaver commits to:

  • Deliver coaching services as described in the program materials
  • Maintain scheduled consultation appointments
  • Provide strategic guidance and implementation support
  • Respond to client communications within reasonable timeframes

Clients are responsible for:

  • Attending scheduled consultation sessions or providing advance notice for rescheduling
  • Actively participating in program activities and implementing recommendations
  • Providing accurate information about career history and goals
  • Maintaining respectful communication

No Guarantees of Outcome

Important: Success in the entertainment industry depends on numerous factors beyond our control, including talent, market conditions, timing, competition, and individual effort. We do not and cannot guarantee specific career outcomes, including:

  • Booking specific roles or auditions
  • Securing representation or contracts
  • Achieving particular income levels
  • Industry recognition or advancement

Our services provide strategic guidance and coaching based on industry knowledge and experience, but results vary significantly between individuals.

Intellectual Property

All content on the wind-beaver website and provided through our services—including text, graphics, images, program materials, methodology frameworks, and strategic tools—is the intellectual property of wind-beaver and is protected by copyright laws.

You may not:

  • Reproduce, distribute, or create derivative works from our materials without permission
  • Use our methodology, frameworks, or materials for commercial purposes
  • Share program materials with non-enrolled individuals
  • Claim authorship of our content

Limited license is granted for personal use of materials during your program enrollment.

Confidentiality

We maintain confidentiality of information shared during coaching sessions. Client information, career details, and personal discussions are not disclosed to third parties except as required by law or with explicit consent.

Clients are also expected to maintain confidentiality of proprietary coaching methodologies and strategic frameworks shared during programs.

Testimonials and Case Studies

With your permission, we may request testimonials or include anonymized case studies based on your program experience. Participation is entirely voluntary, and you may decline without affecting service delivery.

Testimonials reflect individual experiences and do not guarantee similar outcomes for other participants.

Limitation of Liability

To the fullest extent permitted by applicable law:

  • wind-beaver is not liable for any indirect, incidental, consequential, or special damages arising from use of our services
  • Our total liability for any claims related to our services shall not exceed the amount paid by you for those services
  • We are not responsible for career decisions you make based on coaching guidance
  • We are not liable for technical issues, service interruptions, or third-party platform failures

Termination

We reserve the right to terminate or suspend service access immediately, without prior notice, for conduct that we believe violates these Terms of Use or is harmful to other users, us, or third parties, or for any other reason.

Reasons for termination may include:

  • Providing false information during enrollment
  • Abusive or harassing behavior toward staff
  • Violation of confidentiality agreements
  • Unauthorized sharing of proprietary materials
  • Non-payment of agreed fees

Changes to Services and Terms

We reserve the right to modify or discontinue services at any time. We may also update these Terms of Use periodically. Your continued use of services after changes constitutes acceptance of revised terms.

Significant changes affecting existing program enrollments will be communicated directly to affected clients.

Third-Party Links

Our website may contain links to third-party websites or services. We are not responsible for the content, privacy practices, or terms of use of external sites. Access to third-party sites is at your own risk.

Governing Law

These Terms of Use are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.

Severability

If any provision of these Terms of Use is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms of Use, together with our Privacy Policy and any program-specific agreements, constitute the entire agreement between you and wind-beaver regarding use of our services.
